Memorandum of Understanding (MoU)

This MoU is made on ['registration_date'], between GeNX Jobs ( hereinafter mentioned as “GeNX”), the legal entity of GeNX Jobs is ShreeBalaji EduCareer Consultant

and,

['company_name'] (hereinafter mentioned as “Employer”), having its Registered office address at: ['company_address'] and GST- ['GSTN']/ Copy of Gumasta/Trade License attached.



The Employer has approached GeNX for hiring support. GeNX has entered the Company Details under the employer_id: [$epid]. Both parties agree to the following terms:

Employer Responsibilities

  1. Will provide GeNX with clear and complete job details
  2. Will not impose any employment bond (before or after hiring)
  3. Will independently verify candidate’s background and suitability
  4. Will ensure candidates are not engaged in illegal or unethical activities
  5. Will inform GeNX within 2 days after interview about selection or non-selection.
  6. Will pay candidates for any training period on salary prorata basis.
  7. If discontinuing a candidate, will share the reason with GeNX on or before discontinuation
  8. Will provide a safe and secure workplace (especially for female candidates)
  9. Will pay salary to candidates as agreed with them

GeNX Responsibilities

  1. Will source and provide suitable candidates based on the job details shared by Employer
  2. Will ensure that only interested and relevant candidates are forwarded for interviews
  3. Will facilitate communication between Employer and candidates wherever required
  4. Will provide acknowledgment and candidate consent letters in case Employer decides to deduct consultancy fee from the candidate’s salary
  5. Will raise invoices for consultancy fee in a timely manner
  6. Will support Employer in smooth coordination during the hiring and joining process

Consultancy Fee

  1. If the candidate is hired, Employer shall be liable to pay GeNX a consultancy fee equal to the number of days as agreed by the candidate with GeNX from the candidate’s salary.
  2. Cooling Period : the cooling period will be of 3 days from the date of joining
    1. If a candidate quits within 3 days, the Employer may pay salary only for days worked to the candidate directly, and no consultancy fee shall be payable to GeNX, provided GeNX is informed on or before the 4th day.
    2. If the candidate continues beyond 3 days, they will be considered 'hired' and the candidate completes the cooling period but does not work the full month, the Employer shall pay GeNX the consultancy fee and salary for actual days worked. GeNX will then release the candidate’s salary after deducting the consultancy fee.
    3. If the Employer releases only a partial first-month salary, then:
      1. If the amount exceeds the consultancy fee, GeNX shall first receive the full consultancy fee, and the balance shall be paid to the candidate.
      2. If the amount is less than the consultancy fee, the entire amount shall be adjusted toward the consultancy fee. The remaining consultancy fee shall be paid by the Employer in the next cycle, after which any remaining salary (if applicable) shall be released to the candidate.

General

  1. In case for hiring done through College Campusing, this MoU applies to all candidates recruited from the institute via GeNX initially and later directly or indirectly unless both parties agree otherwise
  2. Employer is solely responsible for background checks and final hiring decisions
  3. If a candidate is interviewed through GeNX and later hired by the Employer (within 2 years from the date of interview), such hiring will be treated as through GeNX, and consultancy fee will be applicable as per the agreed terms
  4. All previous agreements, understandings, or MoUs made between the Parties (if any) shall stand null and void upon signing of this MoU
